Terms of Service

1. This agreement

These terms are a contract between you and Toni Lukkaroinen ("we", "us"), whose details are in the Legal notice. They cover the Hiili game client, the game servers and this website (together, "Hiili"). By creating an account or playing, you accept them. If you do not accept them, do not play.

Two other documents are part of the agreement: the Community Rules and, if you use the wallet or buy land, the Wallet, Land and Market Terms. The Privacy Policy explains how we handle personal data.

2. Who can play

Hiili has not been rated by an age rating board such as PEGI, ESRB or USK. It contains combat with fantasy weapons against creatures and other players, and chat and content written by other players that nobody checks before it appears.

3. Your account

4. Your licence to the game

Hiili is protected by copyright and is licensed to you, not sold. We give you a personal, non-exclusive, non-transferable, revocable licence to download the client from our official channels, install it on your own computers and use it to play, for non-commercial purposes, as long as you follow these terms. Open source parts are covered by their own licences, listed in Licences and credits.

You may not:

Videos and screenshots. You are welcome to record, stream and share gameplay, including on channels that earn money from ads or memberships, as long as you do not suggest that we endorse you. We may withdraw this permission for material that breaks the Community Rules.

5. A game in active development

Hiili changes almost daily. We may add, change or remove features, rebalance the game, take servers down for maintenance and, when it is needed, change or reset parts of the world. Where a change affects you significantly we will try to warn you in good time. Changes do not take away your rights under section 11 or the Wallet, Land and Market Terms.

We cannot promise the service will run forever. If we decide to close Hiili permanently, we will announce it on this website and in the game at least 60 days in advance, unless something outside our control makes that impossible.

6. In-game items

Items, coins, skills, pets, buildings and other things in the game are part of the game. We do not buy them back or exchange them for money, and they are not your property in law; your right to them is part of your licence to play. Updates can change what they do and what other players will pay for them, and we do not promise they will keep any value.

Players can sell items to each other for HTN on market stalls in the game, and you can buy coins and land with HTN, under the Wallet, Land and Market Terms. Selling or buying accounts or anything in the game for money or crypto-assets in any other way is not allowed.

Some game outcomes, such as a creature's traits when it is bred, depend on chance. You never pay real money for a random result.

7. What you create

You keep whatever rights you have in what you make in Hiili: builds, sculptures, names, notes on boards, chat messages and similar ("your content"). You give us a worldwide, non-exclusive, royalty-free licence to store, copy, display and transmit your content and to show it to other players, as needed to run, develop and promote Hiili. We can pass this licence on only to the providers that help us do those things.

The world is shared and persistent, so your content can stay in the world after you stop playing, and other players can change or copy it through normal play outside a parcel. The licence lasts for as long as your content stays in Hiili, and for backups for a limited time after that. It does not take away any moral rights that cannot be waived under your country's law.

You promise that you have the right to put your content in the game and that it does not break the law or anyone's rights. If you want your name removed from what you built, ask us (see the Privacy Policy).

8. Conduct and moderation

The Community Rules say what is not allowed. If you break them or these terms, we may remove content, disconnect you or ban your account, depending on how serious the breach is and whether it has happened before. How we moderate, how we tell you why and how to appeal are described in the Community Rules. Moderation is done by people: we do not use automated systems to judge content or to decide bans. The server does automatically refuse actions the game rules do not allow, such as requests sent too quickly.

9. Payments

10. Health and safety

Photosensitivity warning. The game contains flashing lights, including lightning, fire and spell effects. A small number of people may have seizures when exposed to these, even with no history of epilepsy. If you feel dizzy, get blurred vision, have twitches or feel disoriented, stop playing immediately and see a doctor. Take regular breaks.

11. Your consumer rights

If you are a consumer, nothing in these terms limits rights you have under the mandatory law of the country where you live. In the European Union, the EEA and the United Kingdom, for example, you have a legal guarantee that digital content and services conform to the contract, including the updates needed for that. Australian consumers have guarantees under the Australian Consumer Law that cannot be excluded. Please contact us first if something is wrong and we will try to put it right.

For a payment made on itch.io, your right to cancel depends on the law where you live and what you agreed to at checkout. For land, see the Wallet, Land and Market Terms.

12. What we do not promise

To the extent the law allows, Hiili is provided "as is" and "as available". It is unfinished software with rough edges. We do not promise it will be uninterrupted, free of bugs, compatible with your computer, or that progress will never be lost, and we disclaim all implied warranties, such as merchantability and fitness for a particular purpose. Other players' content and behaviour are their own; we do not check everything before it appears.

13. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or intent, or any other liability that the law does not allow to be limited.

Otherwise, to the extent the law allows, we are not liable for indirect or consequential loss, loss of profits or of data, or for the loss of crypto-assets caused by anything described in the Wallet, Land and Market Terms. Our total liability to you for everything relating to Hiili is limited to the greater of 50 euros or the amount you paid us in the 12 months before the claim.

Some countries and US states do not allow these limits, in which case they apply only as far as is allowed. If you are a consumer in the EU, EEA or UK, we are responsible for foreseeable loss caused by our breach of contract.

14. Ending this agreement

You can stop at any time by uninstalling the game. To have your account deleted, see the Privacy Policy. We may suspend or end your access as set out in section 8, or if the law requires it. Sections that by their nature should continue, such as those on your content, liability and disputes, continue after the end.

15. Changes to these terms

We may change these terms when the game or the law changes. We will post the new version here and, for changes that matter, tell you in the game at least 30 days before they apply, unless the change is required sooner by law or is needed to stop abuse. If you do not agree, stop playing and ask us to delete your account before the change applies. Continuing to play after that means you accept.

16. Law and disputes

These terms are governed by the law of Finland, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory law of the country where you live, and you may bring a claim in the courts there.

Please contact us first at toni.lukkaroinen@gmail.com; most things can be sorted out quickly. You can also contact your local consumer authority.

California residents: under California Civil Code section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
